1. Who you are contracting with

The Lumen service (the "Service") is provided by Pascal Joel Collet ("we", "us", "our"), an individual operating from the European Union, trading as "Lumen". By using the Service you enter into a binding agreement with Pascal Joel Collet.

2. Acceptance

By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age to enter into a contract and, if acting on behalf of an organisation, that you have authority to bind it.

3. The Service

Lumen is an educational platform for ETF analysis, portfolio insights, and long-term financial planning. Lumen does not provide financial, investment, legal, or tax advice. Information shown is for general and educational purposes only and is not a recommendation to buy or sell any security. Any decisions you make are your own responsibility.

You must provide accurate information and keep your account credentials confidential. You are responsible for all activity under your account.

We retain all rights, title and interest in the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of content you submit; you grant us a limited licence to host and process it solely to operate the Service.

7. Payments, subscriptions, refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, currency, renewals, cancellations, and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically until cancelled. You can cancel at any time; see our Refund Policy.

8. Service availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free performance. We may modify, suspend, or discontinue features at any time.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid in the 12 months preceding the event. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing excludes liability that cannot be excluded by law (e.g. fraud, death, or personal injury caused by negligence).

11. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated/serious policy violations. You may stop using the Service at any time. Upon termination, your right to use the Service ends; we may delete your data after a reasonable export window, subject to legal retention.

13. Governing law

These Terms are governed by the laws of the seller's country of residence within the European Union, and disputes are subject to the exclusive jurisdiction of its competent courts, without prejudice to mandatory consumer rights in your country of residence.

14. Changes

We may update these Terms. Material changes will be communicated via the Service or by email. Continued use after changes constitutes acceptance.
